How should I respond to a request for information about someone else?

If you receive a request for personal information from anyone other than the individual themselves (or their representative), you will need to consider whether there is any other law which allows or requires you to disclose the information. If not, then you will need to consider whether there are any exceptions to the Privacy Act which will allow you to disclose the information. For example, you can disclose information which is necessary for a Police investigation, or in order to prevent or lessen a serious threat of harm.

If you can’t rely on an exception, or another piece of law, you should not release the information which has been requested.
