Asking for Official information

You can ask for information about our work and other information held by OPC, under the Official Information Act (OIA). We encourage you to search our website or use the AskUs tool before making a request for official information. If you still have questions, please email oia@privacy.org.nz.

What’s excluded

Our correspondence with an agency during an investigation cannot be requested under the Privacy Act or OIA.

Secrecy

We are required to maintain secrecy in respect of all matters that come to our knowledge while carrying out our functions under the Privacy Act. This limits the information we can provide. If you have been affected by a privacy breach and want more information about the agency’s response to the breach, you should ask the agency.

The Privacy Commissioner can only waive the requirement for secrecy in certain situations. We will consider whether these circumstances exist in response to a request for information.

How we work

We will respond to your request as soon as possible, but no more than 20 working days from when we receive it. You can use the response calculator to find the maximum time for our response.

We will contact you if we need to clarify your request, or identify you in consultation on your request, or extend the time for our response to your request. You can contact us on oia@privacy.org.nz if you have any questions during the process.

What to do if you’re not happy with our response

If you’re not happy with our response to your request, you are entitled to complain to the Ombudsman. However, we would welcome the opportunity to resolve any concerns with you first.
