Are aerial photographs of my property a privacy issue?

No, probably not, if the aerial photos are for the purpose of capturing topographical features.

However, if an aerial photo is being taken in close proximity, it may be close enough to capture individuals who could be identifiable in relation to the property. That may be a privacy issue. And if the images are then published or distributed online or using digital communications tools, it may be a breach of the Harmful Digital Communications Act(external link).

For instances of drones filming individuals, see our drones guidance(external link).
