Privacy Act 2020

The AISAs finalised under the Privacy Act 1993 continue in force under the Privacy Act 2020 (Schedule 1, section 12)

AISAs are approved by Order in Council and enable personal information to be shared between (or within) organisations for the purpose of delivering public services. The information sharing provisions are Part 7 sub-part 1 of the Privacy Act.

We provide a summary of the current AISAs (including links to reports about the AISAs).
The lead agency for the AISA must publish a copy of the agreement online, and must report on activity as specified by the Privacy Commissioner (see s13 of the Privacy Regulations 2020).

About AISAs

AISAs are listed in Schedule 2 of the Privacy Act.

The Privacy Commissioner may prepare and publish a report on an approved information sharing agreement under section 151 of the Privacy Act.

The Privacy Commissioner may also review the operation of an AISA 12 months after the Order in Council approving the agreement is made. A report about the findings of the review may be provided to the relevant Minister if the Commissioner believes that the agreement is failing in any manner outlined in section 159.

1.

Information sharing agreement between Inland Revenue and the Department of Internal Affairs

 

This agreement authorises the disclosure of passport information to Inland Revenue to enable it to make contact with overseas based student loan borrowers and liable parents who are in default of their obligations. Read the full agreement here.

The April 2014 reporting notice issued by the Privacy Commissioner under s96S(1)(b) of the Privacy Act was amended in November 2015.  The reporting notice formalises the reporting requirements for this agreement.

Information sharing agreement between Inland Revenue and New Zealand Police

 

This agreement authorises the disclosure of information to New Zealand Police to assist Police to deliver the public service of reducing the rate of serious criminal offending in New Zealand.  

The August 2014 reporting notice issued by the Privacy Commissioner under s96S(1)(b) of the Privacy Act was amended in January 2016.  The reporting notice formalises the reporting requirements for this agreement.

3.

Information sharing agreement for improving public services to vulnerable children

 

This agreement authorises the disclosure of information between the parties to identify vulnerable children, assess their needs and inform the appropriate service response. Read the full agreement here.

The November 2015 reporting notice issued by the Privacy Commissioner under s96S(1)(b) of the Privacy Act formalises the reporting requirements for this agreement.

A report by the Commissioner to the Minister of Social Development under s.96P of the Privacy Act in relation to the approval of the information sharing agreement between the Ministries of Social Development, Justice, Health, and Education, and the New Zealand Police for improving public services to vulnerable children (August 2015).

4.

Information sharing agreement supporting research using the Integrated Data Infrastructure (IDI) at Statistics New Zealand

 

This agreement authorises the sharing of 'Permitted information' with Statistics New Zealand helping inform solutions to solve social issues affecting New Zealanders. Read the full agreement here.

A report by the Commissioner to the Minister of Justice under s.96P of the Privacy Act in relation to the approval of the information sharing agreement between the Ministry of Justice and Statistics New Zealand supporting research using the Integrated Data Infrastructure (IDI) (August 2017).

Information sharing agreement between the Ministry of Education, Oranga Tamariki and the Ministry of Social Development

 

This agreement authorises sharing to provide services to help disengaged youth move into education, employment or training. Read the full agreement here

6.

Information sharing agreement between Inland Revenue and the Ministry of Social Development

 

This agreement authorises sharing to support the delivery of public services by Inland Revenue and the Ministry of Social Development, specifically the accurate and efficient assessment of both tax obligations and entitlement to benefits and subsidies. Read the full agreement here.

7.

Information sharing agreement between the Ministry of Justice and the Crown Law Office

 

This agreement authorises the sharing of ‘Permitted information’ with the Crown Law Office to assist the Solicitor-General to maintain general oversight of the conduct of all public prosecutions, assume responsibility for and conduct Crown prosecutions, and manage and allocate Crown Solicitor funding for the conduct of Crown prosecutions. Read the full agreement here.

A report by the Commissioner to the Minister of Justice under s.96P of the Privacy Act in relation to the approval of the information sharing agreement between the Ministry of Justice and the Crown Law Office supporting the Solicitor-General's statutory duties through the Crown Law Office. (October 2017).

8.

Information sharing agreement between Department of Internal Affairs and Registrar-General

 

This agreement authorises sharing within the Department of Internal Affairs (DIA) to enable the provision of identity services. You can read more about this on the DIA website here. This agreement came into effect by Order-in-Council on 12 December 2019, replacing a previous agreement dated 24 January 2019. Read the full agreement here. 

A report by the Privacy Commissioner to the Minister of Justice under section 96P of the Privacy Act 1993 in relation to the approval of the information sharing agreement between the Department of Internal and the Registrar-General to share personal information about individuals to enable the provision of identity services.

Information sharing agreement between the NZ Gang Intelligence Centre Agencies 

 

This agreement enables the sharing of information and intelligence for the purpose of reducing gang-related harms to individuals and New Zealand society generally.  This agreement came into effect on 4 January 2019. Read the full agreement here.

10.

Information Sharing Agreement between the Ministry of Social Development and the New Zealand Customs Service

 

This agreement authorises the sharing of information to enable MSD to verify the entitlement, eligibility and amount of benefits for beneficiaries travelling overseas; avoid the overpayment of benefits and enable the recovery of any debt due to the Crown. The agreement replaces a previous information matching agreement created under section 280 of the Customs and Excise Act (now section 308). Read the full agreement here. 

11.

Information Sharing Agreement between New Zealand Police and Registrar-General Births, Deaths and Marriages

 

This agreement enables the sharing of registered death, registered name change and non-disclosure direction information between the Registrar-General, Births, Deaths and Marriages and New Zealand Police. The Agreement came into force on 24 October 2019. Read the full agreement here.

12.

Customer Nominated Services Information Sharing Agreement

 

This Information Sharing Agreement assists with the provision of public services that the individual has chosen to apply for, where the delivery of those services is:

- supported by identity information held by DIA or the Registrar-General, Births, Deaths and Marriages;

- provided by DIA

- provided by the Registrar-General.

The AISA reduces multiple requests for the same information by different government agencies and removes the need to provide physical copies of information. It also improves the quality and consistency of information that agencies hold about an individual and makes it easier to detect issues such as identity fraud. Read the full agreement here.

13.

Information sharing agreement between Inland Revenue Department, New Zealand Police, New Zealand Customs Service, and Serious Fraud Office made on 27 July 2020

   

This agreement enables Inland Revenue to receive requests for information from, and to disclose information to the New Zealand Police, New Zealand Customs Service, and the Serious Fraud Office for the purpose of the prevention, detection, and investigation or providing evidence of serious crime.

Inland Revenue is the designated lead agency and is responsible for reporting on this information sharing activity.

 

Death Information Sharing Agreement

 14.

 This agreement authorises the disclosure of death information from the Registrar-General, Births, Deaths, and Marriages to New Zealand agencies to enable the accurate recording and updating of records in their databases. The AISA enables the sharing of the information about deaths to minimise the administrative burden on relatives of the deceased and improve the quality and consistency of information that agencies hold about an individual.
